By setting up a Lasting Power of Attorney (LPA), you can ensure that your wishes are respected and that trusted individuals are legally authorised to act on your behalf, should the need arise.

 

There are two main types of LPA available:


  • Property and Financial Affairs LPA: This type of LPA empowers your chosen Attorney to manage your financial matters, including handling bank accounts, managing investments, and dealing with property. Your Attorney is expected to keep you informed of decisions and involve you in them whenever possible.

  • Health and Welfare LPA: This LPA gives your Attorney the authority to make decisions about your medical treatment, daily care, and overall wellbeing if you are no longer able to do so yourself.

It’s important not to delay. Waiting too long to put an LPA in place can make the process significantly more complicated and costly. If capacity is already diminished, a Court of Protection application may be necessary.
