The public's increasing awareness of degenerative matters such as Alzheimer, disease, dementia and strokes has led to a general understanding that a reduction in mental capacity should be addressed. 

 

Consequently, if you are concerned by a loss of capacity, and the implications that may have, it might be time to prepare for that possibility. There are two types of Lasting Power of Attorney (LPA) available. This will allow you to plan ahead, even if you never need to use them.

 

There is the ;

 

  • Financial Affairs LPA: This LPA grants your appointed Attorney the authority to manage your financial matters, including bank accounts, investments, and property. Your Attorney has a duty to keep you informed about their actions on your behalf and, wherever possible, to involve you in decision-making.
  • Health and Welfare LPA: This LPA allows your appointed Attorney to make decisions regarding your medical care and social well being if you can no longer make these decisions yourself.

 

As a general comment waiting too long to establish an LPA can lead to difficulties, as illness or diminished capacity may limit your ability to complete the necessary process. In this case, a more complex and costly application to the Court of Protection may be required.
