With an aging population, awareness is increasing about the impact of conditions like Alzheimer’s disease, dementia, strokes, and other illnesses that can lead to loss of mental capacity.
Consequently, if you are affected by a loss of mental capacity, you may not be able to make important decisions for yourself. To prepare for this possibility, two types of Lasting Power of Attorney (LPA) are available. This will allow you to plan ahead, even if you never need to use them.
Property & Financial Affairs LPA: This LPA grants your appointed Attorney the authority to manage your financial matters, including bank accounts, investments, and property. Your Attorney has a duty to keep you informed about their actions on your behalf and, wherever possible, to involve you in decision-making.
Health & Welfare LPA: This LPA allows your appointed Attorney to make decisions regarding your medical care and social wellbeing if you can no longer make these decisions yourself.
Waiting too long to establish an LPA can lead to difficulties, as illness or diminished capacity may limit your ability to complete the necessary process. In this case, a more complex and costly application to the Court of Protection may be required.
